These Terms of Service ("Terms") govern your use of SafeInhale (the "app") and the safeinhale.com website. SafeInhale is operated by A+ Hosting Inc., doing business as Intelligence Software Labs, a Nevada corporation ("we," "us," or "our"). It is a free, informational app. By downloading, accessing, or using SafeInhale, you agree to these Terms. If you do not agree, please do not use the app.
1. Informational Use Only
SafeInhale provides general air quality, pollen, weather, and flu information for the United States, for informational and educational purposes only. It is a general-awareness companion, not a professional, clinical, or emergency service. We make no promises, guarantees, or warranties of any kind about results, outcomes, or your health.
2. Not Medical Advice — No Cure or Treatment
SafeInhale is not a medical service, not a diagnostic tool, and not a substitute for professional medical advice, diagnosis, or treatment. We do not promise, provide, or imply any cure, treatment, or remedy for asthma, allergies, sinus problems, or any condition.
The Breathe Score, verdicts, tips, and breathing exercises are general information and general wellness only — not medical guidance. Always consult a qualified healthcare professional for any health decision. Never disregard or delay professional medical advice because of something you read or saw in the app. In an emergency, call your local emergency number.
3. Free of Charge
SafeInhale is provided free of charge — no fee, no account, and no subscription is required to use it. We are under no obligation to provide, maintain, update, or support the app, and we may change, limit, or discontinue the app or any feature at any time, without notice or liability.
4. Provided "As Is" — No Warranties
The app and all information are provided "as is" and "as available," without warranties of any kind, whether express or implied — including, but not limited to, accuracy, completeness, reliability, availability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or available at any given time.
5. Accuracy and Third-Party Data
SafeInhale relies on third-party data providers (including Open-Meteo, the Google Pollen API, Pollen.com / IQVIA, AirNow / U.S. EPA, the U.S. National Weather Service, and the U.S. CDC). Environmental data may be incomplete, delayed, estimated, or unavailable; pollen levels are modeled forecasts, not direct measurements. We do not control and are not responsible for the accuracy, availability, or content of any third-party data or service. You should independently verify conditions and never rely solely on the app for any decision.
6. Limitation of Liability
To the fullest extent permitted by law, Intelligence Software Labs and its owners, creators, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss or harm of any kind, arising from or related to your use of — or inability to use — SafeInhale or any information it provides. You use the app entirely at your own risk and are solely responsible for any decisions or actions you take based on it.
7. Acceptable Use
You agree to use SafeInhale only for lawful, personal, non-commercial purposes. You may not misuse, reverse-engineer, disrupt, overload, scrape, or attempt to gain unauthorized access to the app, the website, or their data sources, or use them in any way that violates applicable law or the rights of others.
8. Intellectual Property
SafeInhale — including its name, logo, design, text, and original content — is owned by Intelligence Software Labs and protected by applicable laws. You may not copy, reproduce, modify, or redistribute it without our permission. Third-party data and trademarks remain the property of their respective owners.
9. Children
SafeInhale is intended for a general audience and is not directed to children under 13. It is not designed to collect personal data from children. Parents and guardians are responsible for supervising any use by minors.
10. Website Forms
If you contact us or subscribe through forms on our website, you agree that the information you submit may be used to respond to you or send the updates you requested, as described in our Privacy Policy.
11. Changes to These Terms
We may update these Terms from time to time. Changes will be reflected here with a revised "Last Updated" date. Your continued use of SafeInhale after changes are posted means you accept the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Nevada, United States, without regard to its conflict-of-law principles. You agree that any dispute relating to these Terms or the app shall be subject to the exclusive jurisdiction of the state and federal courts located in Nevada.
